About these terms
These terms form an agreement between you and SMG Horizon Services Private Limited (“SMG”, “we”, “us”), CIN U82300KL2026PTC104727, registered office 36/267, Mannath Building, Thrikkakara, Ernakulam, Kerala 682021. They apply to the Save My Gold app, website and related services (the “Service”). Please read them with our Privacy Policy, Gold Purchase Policy, Gold Sell-back Policy, Refund & Cancellation Policy and Risk Disclosure, which form part of these terms.
Nature of the Service
Through the Service you can buy physical gold coins from SMG for delivery, buy digital gold that SMG holds in custody for you, view records of your purchases, and sell eligible digital gold back to SMG. SMG is the seller in every purchase and the buyer in every sell-back.
- The Service is not a deposit, savings scheme, collective investment scheme, chit fund or investment advice.
- Gold bought through the Service is not a security regulated by SEBI or a deposit regulated by the RBI, and it is not covered by DICGC insurance.
- The value of gold rises and falls, and SMG does not guarantee any return or resale value.
Eligibility
You may use the Service only if you are an individual aged 18 or over, resident in India, legally able to enter a binding contract, and acting on your own behalf. One account is permitted per person.
Registration and account security
You must provide accurate information and keep it up to date. You are responsible for keeping your device, login credentials and OTPs secure. SMG will never ask for your OTP, UPI PIN, CVV or password. Tell us immediately if you suspect unauthorised access.
KYC and verification
We must verify your identity, and may verify your bank account, before you buy, sell back or receive payouts, as described in our KYC & AML Policy. We may ask for further information at any time where required by law or our risk controls, and may limit features until verification is complete.
Price quotes
Before each purchase or sell-back you will see a quote showing purity, rate per gram, weight, applicable taxes, any charges, the total, a timestamp and the time until the quote expires. A quote is an offer by SMG that is valid only within that window. If it expires before you accept and pay, you will need a new quote. SMG may decline to issue quotes during abnormal market conditions or system outages.
Taxes and fees
GST and other applicable taxes are charged as required by law and shown separately. Any platform fee will be disclosed on the quote before you confirm. You are responsible for any income tax arising on gains from selling gold.
Purchase and payment
You place an order by accepting a quote and completing payment through the hosted checkout of SMG's payment partner. SMG does not collect or store your full card details, CVV or UPI PIN.
Payment confirmation is not gold allocation. Confirmation that your payment has been received means only that SMG has received funds for your order. You do not own any gold until your order shows as allocated in accordance with the procurement and allocation clauses below.
Procurement and allocation
After your payment is confirmed, SMG will confirm physical gold for your order from inventory or procure it from its supplier, and allocate the gold to you in its custody records. If SMG cannot allocate gold to your order for any reason (including supplier failure, a pricing error or a compliance issue), the order will be cancelled and the full amount paid will be refunded to your original payment method in accordance with the Refund & Cancellation Policy.
Invoice and title transfer
On allocation SMG will issue a tax invoice in your name. Title to the gold allocated to you passes to you on allocation. Where your gold forms part of a pooled holding, you will own an undivided share of that pooled gold corresponding to the weight recorded in your account.
Custody
Allocated gold will be held by a custodian on your behalf, separately from SMG's own assets. Details of the custody arrangements are published on the Gold Custody page. These arrangements are being finalised, and purchases will not be accepted until they are in place.
Sell-back
You may offer to sell eligible gold to SMG at the buyback rate quoted at the time. Gold is eligible if it is fully allocated and not subject to a hold, dispute or legal restriction. When you accept a buyback quote, title to that gold passes to SMG and you become entitled to the net payout shown. A sell-back is a new sale and is not a refund of your purchase. SMG may suspend buyback quotes during abnormal market conditions or system outages, and will tell you if it does.
Payouts
Payouts are made only to a bank account in your own name that has been verified on your account. Indicative payout timeline: To be published. If a payout fails, the amount remains payable to you, and we will contact you to complete it. We may delay a payout where needed to complete verification or comply with law.
Gold coin orders
When you order gold coins, the price you accept covers the gold value, making charges, applicable GST and any shipping charge, each shown separately. After your payment is confirmed, SMG will invoice and dispatch the coins to your delivery address in accordance with the Shipping & Delivery Policy. Coins are handed over only to you after an identity check. Risk in the coins remains with SMG until they are delivered to you. Coin cancellations, delivery problems and returns are governed by the Refund & Cancellation Policy.
Converting digital gold to coins
Converting digital gold holdings into coins is not currently available. If introduced, the terms will be published before it is offered.
Refunds and cancellations
Refunds are governed by the Refund & Cancellation Policy, which covers failed, duplicate and unallocated payments and other cases.
Fraud and prohibited use
You must not use the Service for money laundering, fraud, or with funds or accounts belonging to someone else, or attempt to interfere with the Service's security or pricing. You must not exploit obvious pricing errors.
Account restrictions
We may restrict, suspend or close your account where required by law, where we reasonably suspect fraud or a breach of these terms, or on instructions from a competent authority. Where the law permits, we will tell you why. Restriction does not extinguish your ownership of allocated gold; we will explain how you can sell it back or otherwise deal with it, subject to law.
Risks
Buying gold involves risks, including price fluctuation, the buy–sell spread, and counterparty, custody and regulatory risks. Please read the Risk Disclosure before you buy.
Data privacy
We process your personal data as described in the Privacy Policy.
Liability
Nothing in these terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your rights under the Consumer Protection Act, 2019. Subject to that, SMG is not responsible for losses caused by events outside its reasonable control or by your failure to keep your credentials secure.
Complaints and dispute resolution
Please raise any complaint through our grievance redressal process first. Nothing in these terms prevents you from approaching a consumer commission or other forum available to you by law.
Governing law
These terms are governed by the laws of India. Subject to your statutory rights to bring a claim elsewhere, the courts in Kerala have jurisdiction (the specific seat is to be confirmed by counsel).
Changes to these terms
We may update these terms to reflect changes in law or the Service. We will give you reasonable notice of material changes before they take effect. Changes will not apply retrospectively to completed transactions.
